This Terms of Use Agreement (“Agreement”), together with our Privacy Policy at [Goodway Mortgage Privacy Policy](https://www.goodwaymortgage.com/privacy-policy/), constitutes a legally binding agreement between you (“user” or “you”) and Goodway Mortgage, LLC, its affiliated companies, websites, applications, and tools (collectively referred to as “Goodway Mortgage, LLC,” “Company,” “we,” “us,” or “our”). This Agreement governs your access to and use of the [Goodway Mortgage website](https://www.goodwaymortgage.com) and all related Sites offering mortgage brokerage, home loans, and mortgage financing (“Company Services”). Supplemental terms and conditions or documents posted on the Sites are hereby incorporated by reference.
The Sites are intended for users at least 18 years old, and minors’ use of the Company Services is strictly prohibited. By using the Sites, you represent that you are legally capable of entering into binding contracts and agree to comply with all local laws regarding online conduct and acceptable content.
The Company reserves the right to modify this Agreement at any time. All changes will be posted on the Sites, and your continued use of the Sites after any changes constitute your Agreement to the modified Agreement.
By using the Company Services, you represent that all information you provide is accurate and truthful, you will maintain the accuracy of such information, and your use of the Company Services does not violate any applicable laws or regulations.
You are prohibited from using the Sites or Company Services for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, or to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
The content on the Sites, including all trademarks, service marks, and logos, is owned by or licensed to Goodway Mortgage, LLC and is protected by copyright and other intellectual property laws.
Goodway Mortgage, LLC the Sites and Company Services are provided on an “as is” and “as available” basis. We do not warrant that using the Sites will be uninterrupted or error-free.
Goodway Mortgage, LLC. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Sites or Company Services.
You agree to indemnify and hold Goodway Mortgage, LLC harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees) made against them by any third party due to or arising out of or in connection with your use of the Sites or any of the Company Services.
This Agreement and any dispute arising from your use of the Sites or Company Services will be governed by and construed in accordance with the laws of the State of Utah without giving effect to its conflict of law provisions.
Goodway Mortgage, LLC reserves the right to terminate or suspend your access to the Sites and Company Services without prior notice or liability for any reason whatsoever, including without limitation if you breach this Agreement.
